This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website (instaswitch.co), use our services, or interact with partner-branded experiences provided by InstaSwitch.

This Privacy Policy is incorporated into our Terms of Service and governs your use of the InstaSwitch platform. If you do not agree with the terms of this Privacy Policy, please do not use the Service.

InstaSwitch is intended for use by business entities. It is not designed for personal, family, or household use.

1. Information We Collect

We collect information from and about users as follows:

Information You Provide Voluntarily: We collect your first and last name, email address, phone number, business name, bank account and routing numbers, connected platform data (such as Stripe, Gusto, Shopify), and autofill data submitted via our demo request or switching forms.

Information We Collect Automatically: We may collect your IP address, browser type and device information, pages visited and interactions (clickstream data), location information (derived from IP), and use cookies and tracking technologies (see Section 7).

Information from Third Parties: We may collect financial account data from services like Plaid, with your authorization, and updates or confirmations from third-party platforms you've connected to (such as payroll or revenue tools).

We store and process personal data in the United States. If you access the Service from outside the U.S., you understand that your data may be transferred to and maintained in a jurisdiction that may not offer the same privacy protections as your home country.

2. How We Use Your Information

We use the information we collect to provide and operate the InstaSwitch platform, automate or guide bank account switching, display deposit and payment insights, generate switching recommendations, facilitate updates to connected platforms, respond to your inquiries and provide support, improve the platform and user experience, and comply with legal obligations and protect our legal rights. InstaSwitch processes personal data on the basis of user consent, contractual necessity (to provide the Service), and legitimate interest, where applicable and permitted by law.

3. Sharing Your Information

We do not sell your personal data. We may share your data with service providers (such as cloud hosting, analytics, Plaid) who support our operations, with financial institutions or platforms you authorize for switching, with regulators or law enforcement if required by law, and in the event of a business transaction such as a merger or acquisition. Where applicable, we may act on your behalf to initiate changes or transmit data to third-party platforms (such as Stripe, Gusto, or Shopify) as part of your use of the Service. Such actions are based on your explicit authorization. All sharing is done under appropriate confidentiality and security obligations.

InstaSwitch uses service providers (including subprocessors) to perform certain business functions, such as data hosting, analytics, and financial data access. These providers are bound by contractual obligations to safeguard your information.

4. Data Retention

We retain your personal and financial data only as long as necessary to provide the Service, fulfill the purposes outlined in this Privacy Policy, comply with applicable legal and regulatory obligations, and resolve disputes and enforce our agreements. When data is no longer needed, it is securely deleted or anonymized.

If you terminate your account or stop using the Service, we may delete or anonymize your personal data in accordance with this Privacy Policy. However, we may retain certain information as required by law, to resolve disputes, enforce our agreements, or as otherwise permitted under this Privacy Policy.

5. Data Security

We use technical, administrative, and organizational measures to protect your data, including encryption at rest and in transit, role-based access control, and regular system audits and monitoring. While we take reasonable steps to protect your data, no method of transmission or storage is 100% secure. Use of the Service is at your own risk.

While we take commercially reasonable measures to protect your personal data, InstaSwitch cannot guarantee that unauthorized third parties will never be able to defeat our security measures. To the fullest extent permitted by law, InstaSwitch disclaims liability for any unauthorized access, use, or disclosure of your personal data resulting from a breach of our security safeguards, except where caused by our gross negligence or willful misconduct.

You may access or request a copy of your data, correct or update personal data, delete your data (subject to exceptions for legal compliance), and opt out of marketing emails via the "unsubscribe" link in any message. To exercise these rights, contact us at: contact@instaswitch.co
